Terms of use
These Terms of Use ("Terms") govern your access to and use of the Geniusflow AI website, quiz funnel, and SaaS platform (the "Service") provided by Geniusflow AI ("Geniusflow AI", "we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Geniusflow AI provides a lead generation and agent productivity platform, including a consumer quiz funnel, lead CRM, proposal builder, AI voice calling, follow-up tooling, and related features. We are not an insurance carrier or broker. Insurance policies are issued by licensed carriers and brokered by independent licensed agents. Information on this site is for educational purposes only and is not legal, tax, or financial advice.
2. Eligibility and accounts
You must be at least 18 and have authority to bind any organisation you represent. You are responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate information and keep it current.
3. Acceptable use
You must not misuse the Service. You agree not to: (a) use the Service unlawfully or in violation of telemarketing, anti-spam, or insurance regulations; (b) commit fraud or send unsolicited communications; (c) infringe intellectual property or privacy rights; (d) probe, scan, scrape, or interfere with the security or integrity of the Service; (e) upload malware; or (f) reverse engineer, resell, or circumvent technical limits.
4. Intellectual property
The Service, including all software, content, templates, scripts, branding, and documentation, is owned by Geniusflow AI or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your subscription plan. All other rights are reserved.
5. Payments, subscriptions and Merchant of Record
Our order process is conducted by our payment processor Stripe, Inc. Stripe is the Merchant of Record for all our subscription orders, and handles payment processing, sales tax, invoicing, chargebacks, refunds, and transaction-level customer service on our behalf. Subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled. You can cancel at any time from your account or through the Stripe billing portal. Payment, billing, tax, cancellation, and refund mechanics are governed by Stripe's consumer terms in addition to these Terms and our Refund Policy.
6. Service availability
We work hard to keep the Service available but do not guarantee uninterrupted, secure, or error-free operation. The Service is provided on an "as is" and "as available" basis, and we disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law.
7. Suspension and termination
We may suspend or terminate your access to the Service for: material breach of these Terms; non-payment; security or fraud risk; or repeated or serious policy violations. On termination, your right to use the Service ends. You may export your data within 30 days after termination, after which we may delete it.
8. Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of the Service is limited to the fees you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where such limitation is not permitted by law.
9. Indemnity
You agree to indemnify and hold Geniusflow AI harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.
10. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. The courts located in Delaware will have exclusive jurisdiction, except where applicable consumer law requires otherwise.
11. Changes
We may update these Terms from time to time. Material changes will be posted on this page. Continued use of the Service after changes take effect constitutes acceptance.
